The Minister of Justice, Christiane Taubira, recently stirred up trouble when she made decreasing the prison population one of her priorities. The number of detainees in France has reached record highs and this overpopulation, which stems directly from ten years of increasingly harsh criminal justice policies, has caused prison conditions to deteriorate. Associations and justice-system professionals are concerned about post-incarceration difficulties with reinsertion. Can we put an end to the detention-in-all-cases approach? Should we rethink punishment, which is required by the rule of law, by dissociating it from imprisonment? Or should we maintain it, but reform it?
